New Data Protection Law Passed in Indiana
New Law Requires Businesses to
Notify Indiana Customers of Computer Security Breaches of Personal
Information
April 17, 2006 - The state of Indiana recently
passed a law that may affect you. This new law requires that
businesses notify customers who are Indiana residents if a security
breach has potentially comprised their personal data. This new law
does not place any additional requirements on how that data must be
protected or stored. It simply says that, in the event of a breach,
businesses must notify consumers “without unreasonable delay”.
The law provides that, in the event of disclosure of
large amounts of private information -- such as one of over 500,000
Indiana residents -- the requirements for notification may be met by
posting on the company's web site or via a press release. If fewer
consumers are affected, the law does not place any requirements on
how notification must be made.
Businesses that fail to disclose breaches of
security that threaten consumer data are subject to a fine of up to
$150,000. The law does not apply to businesses already covered by
laws such as the Fair Credit Reporting Act, HIPAA, etc., if they
contain similar requirements.
Enforcement of this act is under the jurisdiction of
the State Attorney General. This is a new law, and even lawmakers
and attorneys are unsure how it will affect claims by consumers
against businesses, or whether a company can avoid liability to
consumers by make a timely disclosure. XRBS is ready to assist you
